Welcome to Drawn Fate ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our website at https://www.drawnfate.com (the "Site") and all purchases of products offered through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years of age to use this Site or purchase products from Drawn Fate. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

2. Products and Entertainment Disclaimer

All products sold by Drawn Fate — including tarot decks, oracle decks, guidebooks, and related materials — are intended for entertainment, personal reflection, and spiritual exploration purposes only.

Tarot and oracle cards are not a substitute for professional medical, psychological, legal, financial, or other licensed professional advice. Drawn Fate makes no claims regarding the accuracy, reliability, or predictive capability of any readings or interpretations derived from our products. Any decisions made or actions taken based on the use of our products are your sole responsibility. If you are experiencing a medical or mental health emergency, please contact a qualified professional or emergency services immediately.

3. All Sales Final — No Returns or Exchanges

All sales are final. We do not accept returns, exchanges, or issue refunds under any circumstances, except where a product arrives damaged or materially defective.

If your order arrives damaged or materially defective, you must contact us within 7 days of delivery at support@drawnfate.com with photographic evidence of the damage or defect. Resolution — whether by replacement, store credit, or refund — is at our sole discretion. This policy does not limit any rights you may have under applicable law with respect to defective products.

This policy is disclosed here, on our product pages, and during checkout. By completing a purchase, you acknowledge and agree to this policy.

4. Pricing, Payment, and Order Acceptance

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors. Submission of an order does not constitute acceptance — we reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If an order is cancelled after payment, a full refund will be issued.

5. Shipping and Delivery

Drawn Fate ships within the United States and internationally. Estimated processing and shipping times are provided at checkout and are not guaranteed.

Title and risk of loss pass to you upon delivery of items to the shipping carrier. Drawn Fate is not responsible for delays, loss, theft, or damage caused by the carrier after shipment. If your package is lost or damaged in transit, we recommend filing a claim directly with the carrier. Drawn Fate may, at its sole discretion, assist with resolution but is not obligated to replace or refund shipments lost or damaged after carrier acceptance.

We comply with the FTC Mail, Internet, or Telephone Order Merchandise Rule. If we are unable to ship your order within the stated timeframe (or within 30 days if no timeframe is stated), we will notify you and offer the option to cancel for a full refund.

6. Intellectual Property

All content on this Site — including but not limited to card artwork, illustrations, designs, text, guidebook content, logos, trade names, and the "Drawn Fate" brand name — is the exclusive property of Drawn Fate and is protected by U.S. and international copyright and trademark law.

What your purchase includes: Ownership of the physical product you ordered.

What your purchase does not include: Any intellectual property rights whatsoever. Specifically, you may not:

Reproduce, scan, digitize, or photograph our card artwork or designs for commercial purposes
Distribute, sell, or make available digital copies of our artwork in any format
Create derivative works based on our designs or artwork
Use our trademarks, logos, or brand name in any manner that suggests affiliation, endorsement, or authorization by Drawn Fate

Limited use for reviews and personal sharing: You may photograph or share images of individual cards for non-commercial purposes such as personal social media posts, blog reviews, or educational content, provided you include clear attribution to Drawn Fate. Commercial use of card images requires prior written consent — contact us at support@drawnfate.com.

7. Counterfeit Products

Unauthorized reproduction or counterfeiting of Drawn Fate products is a violation of federal copyright and trademark law. If you encounter suspected counterfeit Drawn Fate products on any marketplace or website, please report it to us at support@drawnfate.com. We actively monitor for and pursue enforcement against counterfeit goods.

8. Website Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

Use the Site in any way that violates applicable law or regulation
Attempt to interfere with the proper functioning of the Site
Use automated systems (bots, scrapers, crawlers) to access the Site without our written permission
Reproduce, mirror, or frame any portion of the Site without our written permission

9. Limitation of Liability

To the fullest extent permitted by applicable law, Drawn Fate and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, your purchase of our products, or any interpretation or use of our tarot or oracle products — including but not limited to damages for loss of profits, data, goodwill, or other intangible losses.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the specific product giving rise to the claim.

10. Disclaimer of Warranties

Our products are provided "as is" and "as available." To the fullest extent permitted by law, Drawn Fate disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, Drawn Fate makes no warranty or representation that: (a) our products will meet your expectations; (b) the Site will be uninterrupted, secure, or error-free; or (c) any tarot or oracle reading or interpretation derived from our products will be accurate, reliable, or applicable to your circumstances.

11. Indemnification

You agree to indemnify, defend, and hold harmless Drawn Fate and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or products; (b) your violation of these Terms; or (c) your violation of any third-party rights.

12. Dispute Resolution

We encourage you to contact us first at support@drawnfate.com with any concerns — most issues can be resolved informally and promptly.

If a dispute cannot be resolved informally, you agree that any claim or dispute arising under these Terms shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual action in small claims court if the claim qualifies.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis, and not as part of a class, consolidated, or representative action.

This arbitration agreement is governed by the Federal Arbitration Act.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any litigation not subject to arbitration shall be brought exclusively in the state or federal courts located in Multnomah, Oregon.

14. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, provide notice via the email address associated with your order. Your continued use of the Site or placement of orders after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Drawn Fate regarding your use of the Site and purchase of products, superseding any prior agreements or communications.
